An immigration refusal letter: organise the decision and deadline questions

Keep the complete refusal decision and organise its reasons, stated review options and dates for qualified advice. Do not begin by rewriting the application or following a generic appeal deadline from a forum. The first task is to establish what this particular decision says and which process, if any, is available.

Keep the complete refusal decision and organise its reasons, stated review options and dates for qualified advice. Do not begin by rewriting the application or following a generic appeal deadline from a forum. The first task is to establish what this particular decision says and which process, if any, is available.

A review route depends on the decision

The UK government’s immigration appeal guidance says an appeal requires a legal right to appeal and that a decision letter usually identifies that right. It also distinguishes administrative review and says the time available depends on where the appeal is made. These are UK procedures, not worldwide deadlines or a determination of your options. Extract the decision into a consultation sheet

Keep the letter intact and use the sheet as an index. Record uncertainty as uncertainty: a delivery date you cannot establish should not be silently replaced with the date you happened to open an email. Include the envelope or notification where it may help explain the timeline.

Separate an error from a missing explanation

Illustrative situation: a decision refers to an employment date that differs from a document in your retained file. Flag the discrepancy and show the relevant submitted document to the adviser. Do not edit the original record or claim the discrepancy necessarily overturns the decision. The adviser needs the full decision, the actual submitted evidence and the delivery timeline to assess it.

Prioritise unresolved rights and dates

Seek appropriately qualified help promptly if a deadline, departure requirement or right to work is unclear. Ask for the proposed scope, fees and next action in writing. This article helps organise a conversation; it does not recommend an appeal, establish that a fresh application is available or predict the result.
