Tax residence questions before an international move: prepare an adviser file

Prepare a factual cross-border tax file before asking for a tax-residence conclusion. List days, homes, work, family ties and income in each relevant country. Take the file to a qualified adviser who can assess the actual jurisdictions; immigration permission and a change of mailing address should not be used as a shortcut to a tax answer.

Tax residence has its own framework

The US IRS describes tax-residence tests for people who are not US citizens, including green-card and substantial-presence tests. Its guidance also identifies special rules and treaty considerations. This is a US framework, not a general day-count rule for every country or a conclusion about a particular person’s filing position. US Internal Revenue Service: Determining tax residency status.

Build the facts before selecting a rule

Record evidence as well as dates. Ask the adviser which countries and tax years need analysis, what deadlines are relevant and which records are missing. Keep retirement accounts, companies and property visible in the enquiry rather than asking only about salary.

Two calendars can overlap

Illustrative situation: a person starts a job abroad while a home, rental income and family remain in the departure country. Give the adviser the complete timeline rather than assuming the first overseas payslip changes every tax obligation. Ask which residence, payroll, treaty and reporting questions need separate analysis. Do not use this example to infer a tax result.

Request an actionable advice scope

Ask which jurisdictions and tax periods the advice covers and which filings or registrations remain outside it. Keep a list of recommended actions and their responsible professionals. This guide helps prepare accurate inputs; it does not calculate residence, select treaty relief, recommend an entity structure or replace individual tax advice.
